DIGITAL PRODUCT POLICY

This Digital Product Policy applies to digital products purchased through the MariusFit website.

1. NATURE OF THE PRODUCT

MariusFit products are digital fitness and educational products delivered electronically.

No physical product will be shipped.

2. MARIUSFIT — 12-WEEK FULL BODY TRANSFORMATION

The MariusFit — 12-Week Full Body Transformation is a digital training and fitness education system designed to provide a structured framework for training, nutrition awareness and progress tracking.

The programme may include:

  • a 12-week training programme;

  • exercise selection;

  • sets and repetitions;

  • rest guidance;

  • RPE guidance;

  • progressive overload guidance;

  • calorie and protein calculation tools;

  • exercise instructions;

  • exercise illustrations;

  • workout tracking;

  • progress tracking;

  • weekly volume tracking;

  • weekly feedback;

  • Quick Start Guide; and

  • other materials specifically stated on the product page.

The features and contents of the product are those described on the relevant product page at the time of purchase.

3. GENERAL FITNESS AND EDUCATIONAL PURPOSE

The programme is designed for general fitness and educational purposes.

It is not a medical, clinical, physiotherapy or rehabilitation programme and does not provide medical diagnosis or treatment.

It does not replace individual assessment or advice from a qualified healthcare professional.

Users are responsible for determining whether the programme is appropriate for their individual circumstances and should seek appropriate professional advice where necessary.

4. CALORIE AND PROTEIN CALCULATOR

The programme may calculate estimated calorie and protein targets based on information entered by the user.

These results are estimates intended for general fitness and educational purposes and are not medical or clinical prescriptions.

Individual nutritional requirements may differ.

The accuracy of the calculations depends partly on the accuracy of the information entered by the user.

Users should review their progress and make appropriate adjustments where necessary.

5. EXERCISE GUIDANCE

Exercise instructions, illustrations and training recommendations are provided as general fitness guidance.

They are not intended to replace individual assessment by a qualified fitness professional, physiotherapist or healthcare professional.

Users are responsible for selecting appropriate weights, exercise variations, training intensity and frequency according to their individual circumstances.

Users should stop exercising and seek appropriate professional advice if they experience significant pain, injury or other concerning symptoms.

6. AI-GENERATED AND DIGITALLY EDITED CONTENT

MariusFit openly acknowledges that certain visual materials used on the website, in marketing or in product presentations may be created or enhanced using AI tools, image-generation technology, graphic design software or other digital editing technologies.

This may include:

  • exercise illustrations;

  • promotional images;

  • website graphics;

  • product mock-ups;

  • fitness imagery;

  • edited photographs;

  • visual representations of the workbook; and

  • other marketing materials.

Some visual materials may be based on reference images and subsequently modified, stylised, enhanced or recreated.

These materials are intended to communicate concepts, provide visual references or present the product professionally.

Unless expressly stated otherwise, promotional or illustrative visual materials should not be interpreted as exact representations of real people, exact exercise execution, anatomy, body proportions or the final appearance of the downloadable workbook.

Where the actual downloadable product is shown through screenshots or previews, those materials are intended to represent the product itself.

7. PRODUCT SCREENSHOTS AND MOCK-UPS

Screenshots and visual previews of the MariusFit workbook may be used to demonstrate the programme.

Some promotional representations may be enhanced, cropped, edited or presented within marketing mock-ups.

Where actual workbook screenshots are displayed, they are intended to demonstrate the actual structure, type and functionality of the product.

The product supplied to the customer will correspond to the product description and contents stated on the relevant product page, subject to reasonable updates or improvements described in this policy.

8. EXCEL WORKBOOK AND COMPATIBILITY

Where the product is supplied as an Excel workbook, customers are responsible for having compatible software capable of opening the supplied file format.

Certain formatting, formulas or functions may display differently depending on the software, device or operating system used.

MariusFit does not guarantee compatibility with every device, operating system, spreadsheet application or software version.

Customers should use the workbook as supplied and should avoid intentionally altering formulas or protected areas unless instructed to do so.

Nothing in this section limits any statutory consumer rights that apply where the digital content itself does not conform to the contract.

9. USER-ENTERED DATA

Where the workbook requires the user to enter personal information, measurements, training data or other information, the user is responsible for entering accurate and appropriate information.

Incorrect or incomplete information may result in inaccurate calculations, tracking or recommendations.

10. PRODUCT UPDATES

MariusFit may update or improve the product from time to time.

Updates may include corrections, improvements, formatting changes, content changes or technical improvements.

Unless expressly stated otherwise, MariusFit does not guarantee that particular future updates or additional features will be provided.

Any mandatory consumer rights relating to the digital content remain unaffected.

11. PERSONAL LICENCE

The product is supplied to the purchaser for their personal use.

Unless otherwise agreed in writing, the purchaser may not:

  • copy the product for distribution to others;

  • share the product or download files with other people;

  • resell the product;

  • redistribute the product;

  • upload the product to public or shared platforms;

  • commercially exploit the product;

  • reproduce substantial parts of the product for use in another commercial programme; or

  • present the product or substantial parts of it as their own.

Nothing in this section prevents the customer from exercising rights that cannot legally be restricted.

12. DIGITAL DELIVERY

Following successful payment, the product will be delivered electronically through the delivery method specified at checkout.

MariusFit will make reasonable efforts to resolve legitimate delivery or access problems.

13. TECHNICAL PROBLEMS

MariusFit will make reasonable efforts to assist with legitimate problems relating to delivery or access.

MariusFit is not responsible for technical problems caused solely by:

  • unsupported software;

  • unsupported devices;

  • internet connection problems;

  • third-party applications;

  • third-party service outages;

  • customer modifications to the workbook; or

  • circumstances outside MariusFit's reasonable control.

This section does not exclude or restrict any statutory consumer rights that apply where MariusFit is responsible for a problem with the digital content or its delivery.

14. STATUTORY CONSUMER RIGHTS

Nothing in this policy excludes, restricts or limits any statutory consumer rights.

Digital content supplied to consumers must comply with applicable consumer protection law, including applicable requirements relating to description, satisfactory quality and fitness for purpose.

Where digital content does not comply with applicable statutory requirements, consumers may have legal remedies including repair or replacement and, where applicable, a price reduction or other remedy provided by law.

If any provision of this policy conflicts with a mandatory consumer protection law, the mandatory legal requirement will apply.
